Report Reveals Global Expansion Trends in Ediscovery

Kroll Ontrack’s New Frontiers in Ediscovery Report highlights the expanding international use of ediscovery techniques and technologies to tackle data privacy measures, investigative demands and regulatory scrutiny.

MINNEAPOLIS – November 10, 2015 – Released today, the New Frontiers in Ediscovery Report by Kroll Ontrack takes a comprehensive look at ediscovery in different regions around the world, including Europe, the United States and Asia.

“We’ve witnessed an exponential rise in the use of ediscovery services in countries beyond the traditional homeland markets of the US and UK, where take-up of ediscovery was initially driven by changes to the legal system governing disclosure and discovery in legal proceedings,” said Tim Phillips, Managing Director of Kroll Ontrack International Legal Technologies. “Today, ediscovery is becoming an important element of the business and corporate governance landscape, even for countries like Germany and Hong Kong that do not have an obligation to provide ediscovery under their legal framework.”

In addition to shedding light on regional law, local nuances and the huge progress made in the capabilities of ediscovery itself, the report addresses why the global financial services sector in particular is applying ediscovery to its own unique market challenges; how organizations are using ediscovery to break up cartels; and where technologies such as predictive coding are heading to next.

“As a leader in the global industry, we believe it is important to document these changes and to highlight the rapid growth of ediscovery as a problem-solver for everything from regulatory compliance to dealing with dawn raids, and from unbundling legal services to forensic investigations,” adds Phillips. “As well as crossing additional geographical frontiers, ediscovery technology is also hitting new technology milestones. Predictive coding is now used in almost every new matter we are instructed on in the U.K., for example.  Acceptance is growing in the Courts of Law in the US and Europe and will mean even more demand for clever ediscovery technology in the future.”
